Terms & Conditions

The terms that apply to this website and to any cask acquisition through Avenleigh Barrel Co.

⚑ Draft for review — the wording below is a professional starting point. Final legal text (company details, jurisdiction, data-protection and cookie specifics) must be confirmed by a qualified UK legal/compliance adviser before publication.

1. Introduction

These terms and conditions govern the relationship between you and Avenleigh Barrel Co (“we”, “us”, “our”) and the use of this website and our services. By making an enquiry or acquiring a cask through us, you agree to these terms.

Avenleigh Barrel Co is a specialist distributor of rare and collectible whisky casks. Company name, registered address and company number: [to be confirmed].

2. Eligibility

Our services are intended for persons aged 18 or over. By using this site you confirm you are at least 18 years of age.

Nothing on this site is directed at any person in any jurisdiction where publication or availability is prohibited.

3. Nature of our service

We act as a distributor of physical whisky casks. We do not provide financial, investment, legal or tax advice, and we do not assess the suitability of any acquisition for you.

Purchases of physical whisky casks are generally not regulated by the Financial Conduct Authority and do not carry Financial Services Compensation Scheme or Financial Ombudsman Service protection.

4. Enquiries and no offer

Information and any indicative prices on this site are provided for general information only and do not constitute an offer to sell. Availability is live and subject to change.

A displayed price is a purchase price, not a forecast. Market values are variable and a buyer may not be available when you wish to sell.

5. Purchase process and contract

Where you proceed with an acquisition, the specific cask, price, costs and terms will be set out in a separate purchase agreement or invoice. A binding contract forms only when we confirm your order in writing.

Ownership documentation and warehouse records supplied are described in the purchase agreement. Any claim of direct title is confirmed only where the legal and warehouse process is contractually in place.

6. Costs and storage

Applicable costs may include the cask price, bonded storage, insurance, transfers, sampling, regauging, sale fees, transport, bottling, duty and VAT. The relevant fee schedule is provided before purchase.

7. Restrictions

Distillery naming and bottling rights may be restricted even where the liquid originated at a named distillery. Such rights should never be assumed and are disclosed per cask.

8. Resale and routes

There is no regulated exchange and no guaranteed buyer, price or timeframe for any cask. Continuing maturation, resale and bottling are possible routes, each subject to condition, rights, demand, cost and regulation.

9. Liability

To the fullest extent permitted by law, we exclude liability for indirect or consequential loss. Nothing in these terms excludes liability that cannot be excluded under applicable law. [Detailed liability wording to be confirmed by legal adviser.]

10. Intellectual property

The content, design and marks on this site are owned by or licensed to Avenleigh Barrel Co and may not be reproduced without permission.

11. Governing law

These terms are governed by the laws of [England and Wales / jurisdiction to be confirmed], and the courts of that jurisdiction have exclusive jurisdiction.

12. Changes and contact

We may update these terms from time to time; the version published here applies. For any questions, please contact us.
